1. Agreement to Terms

By accessing or using the Ingesh Technologies website at ingeshtechnologies.com, or by engaging us for any service, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use this website or our services.

2. Our Services

Ingesh Technologies provides software development services including website development, mobile and web application development, cloud infrastructure, DevOps, AI and machine learning integrations, and ongoing maintenance and support. Specific deliverables, timelines and pricing for each engagement are agreed separately in a written proposal or contract.

3. Free Consultation

We offer a free initial consultation to understand your project requirements. This consultation does not constitute a contract or guarantee of services. No work will begin until a formal proposal has been agreed and an initial payment has been made, unless otherwise agreed in writing.

4. Intellectual Property

Upon receipt of final payment for a project, all intellectual property rights in the custom code, design and content produced specifically for you transfer to you. We retain the right to use general tools, libraries and frameworks we developed independently before or during your project. We may reference the completed project in our portfolio unless you request otherwise in writing.

5. Payments

Payment terms are set out in each individual project proposal. Typically, a deposit is required before work begins, with the balance due on completion. We reserve the right to pause work on a project if payments become overdue. Ownership of deliverables transfers to you only upon receipt of final payment in full.

6. Client Responsibilities

You agree to:

  • Provide accurate, complete information and content required for us to do our work
  • Review and provide feedback on deliverables within agreed timeframes
  • Ensure you have the right to use any content, images or materials you supply to us
  • Not use our services for any unlawful, harmful or deceptive purpose

7. Delays

We will make reasonable efforts to meet agreed timelines. However, delays caused by late provision of content or materials by you, or by factors outside our reasonable control, will adjust delivery dates accordingly. We will notify you promptly of any delays on our side.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Ingesh Technologies shall not be liable for any indirect, incidental, special, consequential or punitive damages, including loss of profits, data or business, arising from your use of our services or this website. Our total liability to you for any claim shall not exceed the total amount paid by you for the relevant service.

9. Third-Party Services

We may recommend or integrate third-party services (such as cloud providers, payment gateways or analytics tools) as part of your project. We are not responsible for the performance, availability or terms of those services. Their respective terms and privacy policies apply to your use of those services.

10. Confidentiality

Both parties agree to keep confidential any proprietary or sensitive information exchanged during an engagement, unless disclosure is required by law or agreed in writing. We are happy to sign a formal NDA if required before project discussions begin.

11. Termination

Either party may terminate a project with 14 days' written notice. In the event of termination, you are responsible for payment for all work completed up to the termination date. Work completed before termination remains the property of Ingesh Technologies until full payment is received.

12. Governing Law

These Terms and Conditions are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of Ujjain, Madhya Pradesh, India.

13. Changes to These Terms

We may update these Terms from time to time. The "last updated" date at the top of this page reflects any changes. Continued use of the website or our services after a change constitutes acceptance of the updated Terms.
